FDA and FSMA Requirements for Importing Food Ingredients from India

Food imports into the United States are regulated by the FDA under the Federal Food, Drug, and Cosmetic Act and the Food Safety Modernization Act (FSMA) of 2011. FSMA introduced the most significant overhaul of US food import regulation in decades, placing legal responsibility on US importers to verify their foreign suppliers' compliance with FDA standards. Here is what US buyers importing from Atlas AgroFood need to understand:

Foreign Supplier Verification Programme (FSVP)

Under FSMA, US importers must have a documented FSVP file for each foreign supplier and each product they import. The FSVP must include hazard analysis, supplier verification activities, and documentation of the supplier's compliance with applicable US food safety standards. Atlas AgroFood provides all documentation required to build and maintain your FSVP file β€” including COA, microbiological testing, pesticide residue reports, and facility information.

Prior Notice (PN)

All food shipments entering the US must be submitted to the FDA via Prior Notice before the shipment arrives at the US port of entry. Prior Notice is filed electronically through the FDA's Prior Notice System Interface (PNSI) and is typically handled by your US customs broker. We provide all required product, manufacturer, and shipment data to support accurate Prior Notice submission.

FDA Facility Registration

Under FSMA Section 415, food facilities that manufacture, process, pack, or hold food for US consumption must register with the FDA biennially. Atlas AgroFood's manufacturing facility is registered with the FDA. Our FDA registration number is available on request for inclusion in your FSVP documentation.

Preventive Controls for Human Food Rule

FSMA's Preventive Controls rule requires that food manufacturers identify hazards and implement preventive controls in their production processes. We maintain a documented food safety plan that addresses hazard analysis, preventive controls, monitoring, and corrective actions β€” consistent with the requirements that US importers must verify under FSVP.

Pesticide Residues: EPA Tolerances vs EU MRLs

US pesticide residue limits (EPA tolerances) are set by the Environmental Protection Agency under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Federal Food, Drug, and Cosmetic Act. EPA tolerances differ from EU MRL limits and are not directly equivalent β€” a product that meets EU MRLs does not automatically meet EPA tolerances, and vice versa.

For US importers, we recommend specifying pesticide residue testing against EPA tolerance levels at the time of inquiry. Unlike the EU, where pesticide testing is a standard compliance expectation for Indian-origin spices, US regulatory enforcement of pesticide residues on food ingredients is risk-based and subject to FDA import sampling. However, having clean pesticide residue data on file protects your business in the event of an FDA import alert or sampling event.
